M.A. ZAFAR, J.-- The brief facts of the case are that Samuel the petitioner Tiled an application before SHO Liaqat Abad, Lahore for registration of the case against respondent stating therein that petitioner is residing abroad in Australia in connection with job for the last many many years, he came to know that certain evil-doers have occupied the house of the petitioner bearing No. 17, Gali No. 35, falling in Khasra No. 187, Khewat No. 156 situated at Nasarat Road Modern Colony Kot Lakhpat, Lahore which he had purchased through a sale-deed duly registered with Sub-Registrar Data Gunj Bakhsh Town, Lahore, vide document No. 25721, book No. 1, volume No. 6166 dated 13.09.1975.
2. That the petitioner filed a complaint on 23.04.2007 under Section 3 of the Illegal. Dispossession Act which was dismissed by the learned Addl. Sessions Judge, Lahore vide orders dated 05.10.2007 on the ground that a Civil Suit is pending between the parties from the date of institution of this complaint.

After hearing the learned counsel for the parties and perusing the record I have observed that there is no evidence on record to the effect that the respondents are professional land grabber or they belong to any Qabza Group. Moreover, a Civil Suit filed by Muhammad Arif respondent No. 3 in respect of the same property having filed on the same day when the present complaint was filed is pending adjudication in the Civil Court and in addition to that the present petitioner has also filed a suit for cancellation of document i.e. Sale-deed and power-of attorney allegedly executed by him and in both the suits status-quo order has been issued by the Civil Court. The learned Addl.
Sessions Judge vide impugned order dated 05.10.2007 rightly dismissed the complaint in view of the law laid down by the learned Full Bench of this Court in "Zahoor Ahmad & 5 others v. The State & others" (PLD 2007 Lahore 231).
4. For, the foregoing reasons there is no force in this petition and the same is accordingly dismissed. .
