1. According to the precise facts embody in the complaint, complainant went into the office of the respondent where respondent inquired from the complainant that he need Electricians, Carpenters, Masons, Welders, Duct man A/c, Plumbers, Aluminum workers and general workers for UAE. Respondent further asked to the complainant that he will arrange VISA if complainant will produce him some man power for the supra purpose. At that movement complainant refused to ( the respondent but later on complainant visited the office of the respondent and submitted service for his cousin. Respondent demanded Rs.1,40,000/- for Carpenter visa. Respondent guided to the complainant regarding his terms and conditions about his services. Complainant paid Rs. 30,000/ to the respondent as an advance amount and later on he paid him Rs.10,000/ through bank receipt. Still respondent has not full fail his responsibility nor he returned the amount received by him. Therefore a decree for Rs.10,00,000/ alongwith Rs.40,000/- real amount received by the respondent be awarded in favour of complainant against respondent.
2. After admission of this complaint respondent was summoned through the notices but he did not turned up into the court. Again order dated 05-11-2009 it was affirmed to the court that through usual process attendance of the respondent is not possible and it was deemed by this court that respondent attendance can be procured through the substituted service. A praspaltion was issued to the respondent through the news paper daily "The News". Despite the publication against the respondent he did not turned up into the court he was proceeded ex-part on 12-01-2010.
3. Complainant got recorded his ex-part statement on 27-01-2010 and this complaint was fixed for argument for today.

5. Complainant himself appeared before the court and entered into the witness box. He deposed in statement that on 10-03-2009 he visited the office of the respondent where he got offer through the respondent that he has some Visa for UAE for the post of Electricians, Carpenters, Masons, Welders, Duct man A/c, Plumbers, Aluminum workers and General workers. He paid Rs.30,000/- to the respondent verbally and Rs.10,000/- through the receipt. The receipt for the Rs.10,000/- is Ex- AW1/2 which bear the emboss of the Standard Charted Bank, Aziz Shaheed Road, Sialkot. The said receipt indicated the amount as title Farakh Ahmed, who is respondent. It means that the amount through deposit in the account of respondent is received by him. Respondent is not turned up into the court to defend this complaint. The statement of the complainant is only on the record against the statement, hence, complaint is ex-partly accepted to the extant that complainant is entitled Rs.40,000/- (Forty thousands only) which he paid to the respondent. So far the arguments that he is entitled for Rs.10,00,000/-. In this regard he has not deposed in his statement that why he entitled for Rs.10,00,000/- hence, claim of the complainant is declined for the payment of Rs.10,00,000/-.
6. Complaint is accepted accordingly. File be consigned to the record room after its compilation.
