' MANSOOR AKBAR KOKAB, J.--Petitioner contends that because of hostility and personal grudge of two professors against him he was failed in a subject i.e, Transport Phenomena (Ch.E-407) as he secured 49 marks out of 150 marks. Later on by virtue of an application under Order I, Rule 10 C.P.C., the alleged Examiner Professor Kamran Sibtain has been made a party to the present writ petition and he was said to be the one Professor among the two, who were bearing grudge and manipulated the failure of the present petitioner.

Apart from the comments of respondents Nos.1 and 2, Professor Kamran Sibtain is appearing in person along with his counsel and states on oath that though he was internal Examiner but the paper was checked by external examiner of Punjab University, who evaluated the marks of the said paper and he being the internal Examiner was competent to review the same marking having the power of only plus and minus 5 marks, which he even did not do, as he was satisfied with the marking made by the external examiner.

Learned counsel for respondents] Nos.1 and 2 referring the comments submitted by the University makes it clear that the applications made by the petitioner to the University in this regard were thoroughly examined and the competent Authorities being satisfied with the correct marking as per rules rejected the applications on three occasions. In the circumstances, the present petition is found mere on misapprehension, especially in the wake of statement made by the internal Examiner, which was specifically made a party by the petitioner. Petition is dismissed.
