Ex-parte arguments heard and record perused.

2. The petitioner, a resident of Akbar Town (Gojra Road New Samundri) got his house painted from respondent No.1 in consideration of Rs.25,000/- but the respondents did not do the needful satisfactorily. On petitioner's protest, the respondents paid no heed to redress his grievance nor they responded petitioner's legal notice.

3. Process was issued for the appearance of respondents but they did not appear to contest the petition. They were, therefore, proceeded exparte.

4. Petitioner appeared as PW-1 and also placed on record his sworn affidavit and documentary evidence in support of his claim.

5. As already stated, petitioner's evidence has not been rebutted by the respondents since proceeded ex-parte, therefore, the same is relied upon and petitioner's claim is decreed to the extent of refund of amount paid as advance to the respondents, compensation / damages for physical discomfort / mental agony (Rs.15,000/-) and litigation expenses (Rs.5000/-) whereas petitioner's remaining claim is hereby dismissed. After due completion, file be consigned to record room.
