ORDER

1. ' M. SALEEM CHAUDHRY (CHAIRMAN).-The record has been produced. It is admitted that all the adverse reports earned by the appellant had been categorized as B' by the Department. The department, however, contended that in the year 1972 in the integrity column of his ACR it was remarked "cannot be vouched". Similarly in 1973 and 1975 the integrity was reported as "doubtful" and "controversial" respectively. But the fact remains that all these reports have been categorized as '13' and under the Punjab Police Rule No, 15.17 relating to the Annual Confidential Reports, the report falling in Category 'C' only furnish the basis for action. The Department has not been able to satisfy us that the action initiated against the appellant was within the framework of the aforesaid Rule. We are, therefore, of the opinion that the action taken against the appellant was not in accordance with the Police Rules. The appeal is, accordingly, allowed and the impugned orders are set aside. There will be no orders as to costs.
