1. Muzafar Iqbal Butt in this complaint submitted that he purchased a washing machine and a Geezer of the respondent's company through its dealer Farooq Ahmed in the year 2006. A guaranty card was issued by the respondent whereby the service facility upto ten years free of cost was promised. In August 2009 the Geezer and washing machine become out of order. Respondent was informed but he failed to provide service. Again on 03-09-09 and 05-09-09 respondent was asked to fulfill his promise. The service man visited the house of complainant but before doing something demanded service charges in advance. According to the complainant respondent went back to the promise of free services as per guaranty card.
2. Respondent appeared in the Court submitted reply stating that guaranty card was issued only for washing machine and not for the Geezer. Respondent was proceeded expart due to his absence on 19-01-10. Exparte evidence of the complainant was recorded.

Complainant appeared as PW1 and produced on record copy of legal notice mark "A", receipts of dispatch of legal notice exhibit "PA", purchase receipt of washing machine exhibit "PB", purchase receipt of Geezer exhibit "PC", guaranty card of washing machine exhibit "PD" and complaint card exhibit "PE"
4. I have heard the arguments and perused the record.
5. Sale of washing machine and Geezer by the respondent company to complainant is an admitted fact. Contention of respondent is that guaranty card was issued only for washing machine and not for the Geezer. If the version of the respondent is admitted even then respondent has no justification for not providing free of cost service to the complainant for washing machine.
Respondent has not denied the contention of the complainant about visiting of complainant by the crafts man of the company and demanding the service charges by him which was totally unjustified as the respondent company was bound to provide free service. In this way respondent has been found guilty of providing deficient service to the complainant. No guaranty card of the Geezer has been placed on record by the complainant. Therefore, claim of the complainant is about deficient service on the part of respondent to the extent of washing machine is accepted.
Respondent company is directed to provide skilled services to remove the defect of washing machine of the complaint without any charges within fifteen days of the passing of this order and also pay Rs. 1000/- as legal expenses as well as Rs. 2000/- as counsel fee. Besides, respondent is also burdened with fine of Rs. 5000/- for his deficient service to the complainant which shall be deposited within one month of passing this judgment in the state treasury. File be consigned to record room after its due completion.
