1. I am going to decide ex-parte order. The petitioner has stated in his affidavit Ex-P/1 that he purchased Nokia Mobile Set model 5030 from respondent No. 1 on 10 07-10 for Rs. 2200/-Waranty was also given to me but it went out of order after four days. Notice was sent upon the respondent but respondent cared a fig. The complainant has also produced documentary evidence Ex-P/2 to Ex-P/6 .Thus the claim is decided in the way that respondent No. 1 shall pay amount of Rs. 2200/- to the petitioner subject to return of mobile set similarly Rs. 10,000/- is awarded to be paid by respondent No. 1 to the complainant for mental torture whereas remaining claim of the petitioner is hereby dismissed being on the higher side with no order as to cost.
