ORDER

1. Today the matter was fixed for disposal of Miscellaneous No,8386/2007 moved by the petitioners stating that the petitioners have agreed to compensate the respondents and other encroachers, who had settled the matter outside the court in A terms as narrated in the application but as Mr. Muhammad Jamil, learned counsel for respondent No,3 has no notice of this application, therefore, he claims copy of the same to go through it.

' Mr. Manzoor Ahmed, learned counsel for City District Government Karachi states that in compliance of the orders of this Court passed on 22-5-2007 and 17-10-2007 both City District Government, Karachi and Katchi Abadi Authority were held responsible to persons having been compensated by realising the amount from those delinquent officers, who were responsible for allowing the encroachment and declaring the road as Katchi Abadi.

3. ' In support of his statement enquiry conducted against those officers has been filed alongwith an application dated 3-7-2007 (Misc. No,5199/2007). It is further stated by Mr. Manzoor Ahmed that the affectees have been compensated from the very amount realised from those officers, as such the grievance of the petitioners has been resolved. Anyhow in view of the reservation made by learned counsel for respondent No,3 to the compromise application moved by the petitioners, learned counsel for the petitioners states that he withdraws C.M.A No,8386/2007 and he may be allowed a simple withdrawal of petition with no terms and conditions.
