' The learned counsel for the petitioner submits that he had been awarded contract for running the above Marriage Garden for five years which expires on 30-6-2009 and he has received a Notice No,GTK/TMO/PS/1911/2009, dated 30-6-2009 for vacation of the subject Marriage Garden. The learned counsel submits that he has invested considerable amount in the above marriage hall and he intends to re-bid when the auction proceeding takes place.

' We, first of all, expressed our gratitude to Mr. Manzoor Ahmed, the learned counsel for C.D.G.K., who was present in Court yesterday and had volunteered to inform the respondents about this petition and the respondents and their Advocate, Mr. Tariq Jameel, and present before this Court today without notice which they waive.
3. ' The respondents' counsel has submitted that the contract has ended and the premises should be handed over back to the respondents. However, in order to save both the parties from inconvenience, we are disposing this petition in the following terms.

We are initially appointing the Nazir of this Court to take over the possession of the property in question and prepare the report of the construction available on the property in question and make inventory of all the goods lying in the Marriage Garden and then replace the lock of the Marriage Garden with his own lock and depute four Security Guards at the expenses the petitioner on the said property for 24 hours surveillance of the property in question. The respondents will soon start the process of re-auctioning the lease of the Marriage Garden and we direct that the tender or the auction bid of the petitioner may also be considered and may be disposed of on merits as per the discretion of the respondents in accordance with law. If the bid of the petitioner is accepted, the Nazir will, on the acceptance of the bid, handover the possession of the property in question to the petitioner. If the bid of the petitioner is not accepted and is decided in favour of some other bidder, the Nazir will along with the representatives of the petitioner and the respondents visit the site and after consultation with both the parties. Will handover all the goods which belong to the petitioner, to the petitioner and this exercise should, preferably, be completed within 3 to 5 days and the keys of the premises should be handed over to the respondents after all the goods of the petitioner have been removed.

' The keys of the property in question have been handed over to the Nazir in Court and the inspection will be carried out by the Nazir today at 3-00 p.m. Any if the petitioner and the respondents want to depute their representative, their representatives should be present at the site at 3-00 p.m. Today.

' Once the advertisement is published, the Nazir is directed to depute a representative to be present at the site between 5-00 to 7-00 p.m. Which time period will be mentioned in the advertisement for the prospective bidders to come and inspect the property. If the respondents represent to the Nazir that they intend to carry out renovation work at the site, the Nazir will depute a representative under whose supervision this process will be carried out.
7. ' The fee of the Nazir is fixed at Rs.20,000 and Rs. 2,000 (Rupees two thousand only) for every hour when the representative of the Nazir is present at the site in connection with the above-said process and this fee will be paid by the petitioner.
8. ' The respondents are directed to conclude the auction proceedings before 15th August, 2009. We once again express our gratitude to Mr. Manzoor Ahmed.
