M.A. ZAFAR, J. --- The petitioner Muhammad Aslam aggrieved from the order dated 23.6.2008 passed by the learned Additional Sessions Judge, Arifwala/Ex-Officio Justice of Peace has filed this petition under Article 199 of the Constitution of Islamic Republic of Pakistan, 1973 with the following prayer:- it is therefore, most respectfully prayed that while accepting the present writ petition the impugned order dated 23.6.2008 passed by learned respondent No. 1, may kindly be set aside, thereby declaring that the petition filed by respondent No. 3 is false, frivolous and baseless and against the principle of natural justice.
It is further prayed that till the final decision of the present writ petition the operation of the impugned order dated 23.6.2008 passed by respondent No. 1 may kindly be ordered to be suspended.
It is also prayed that during the pendency of the instant petition the respondent No. 2/SHO may kindly be directed not to harass and pressurize the petitioner and his other family members in the interest of justice.
Any other relief with this Hon'ble Court deems fit and proper may also be granted."
2. The operative part of order reads as under:- "The SHO concerned is directed to personally look into the matter and redress the grievance of the petitioner if any. The petition is disposed of accordingly."
3. The main contention of learned counsel for the petitioner is that prior to the aforesaid order, Mst.
Nusrat Parveen wife of Dildar Ahmad respondent No. 3 also filed a similar application before the learned Sessions Judge, Arifwala and in which similar order was passed by the learned Additional Sessions Judge, Arifwala on 5.3.2008 and having failed to get a case registered at the instance of his wife Mst. Nusrat Parveen, respondent No. 3 mala fide filed the petition before the learned Ex- Officio Justice of Peace. The order passed by the learned Additional Sessions Judge, Arifwala/Ex- Officio Justice of Peace does not require to be set-aside with the hope that the SHO concerned will look into the matter impartially, fairly, honestly and without being influenced by any extraneous circumstance. With the above observations, this petition stand disposed of. .
