1. Vide this order I am going to decide the complaint U/s 25 of the Punjab Consumer Protection Act 2005 whereby the complainant has sought amount of Printer and Scanner Rs. 5000/-, mental agony and torture Rs. 5,00,000/- and an amount of Rs. 27000/- on the pretext of loss per day due to none functioning of Printer and Scanner for a period from 20-3-10 to 17-4-10. In this way, total amount claimed as Rs. 5,32,000/- 2 The main agony of Muhammad Amion appearing as PW-1 as narrated in Ex-P/1 is that he purchased a Printer alongwith Scanner of HP 1100 for an amount of Rs. 5000/-on 20-3-10 with the grantee that said Printer could be exchanged, replaced or returned within one month. Moreover, additional warranty of two months was also given. The duty of the delivery of the said Printer was with the respondent, it was also duty of the respondent to give installation CDs of the Scanner.
2. When respondent No.2 alongwith boy Nomi took Printer to the School, very astonishing that was not the Printer which had been shown to the complainant. When the factum was discussed to the respondent No. 2 he told that the Printer which had already been shown to the complainant had been sold to some other person and he gave warranty that the Printer being given to the complainant was of a good quality and would work in a good way. According to Muhammad Amion complainant, he asked both the respondents to get the Printer checked on the incoming of light within three Muhammad Amion V/s Mr. Naveed Hafeez etc. minutes but both the persons went away by saying that the Printer Scanner had no need to install as it would install automatically on Window XP.
3. 3 On incoming of the light, the complainant was astonished to see that the Printer could not work upon which complainant telephonically informed the respondents but they gave a deaf ear. On 27- 3-10 he went to the shop of the respondent and repeated requests but despite meeting the demand of the complainant the respondent delivered threatened upon which legal notice were sent on 17-4-10 and 5-5-10.
4. 4 I have scanned oral as well as documentary evidence. Plea of the complainant is basis on sound footing, of course, male practice with complainant has been committed, the intention of the respondents remained malafide throughout they should had taken steps towards the grievance of the complainant. The complaint in hand is decided in the way that respondent would replace the Printer and Scanner within two weeks from today and towards the mental agony I award Rs. 10,000/ to the complainant- Rest the claim about damages is dismissed.
