1. The appellant Ms. Shazia Sarfraz has filed this appeal challenging the order dated 28.3.2005 passed J.M. No. 23/2004 in Suit No. 1035/2005. The appellant claims that she has also filed Suits Nos.
2. 1012 and 1013 of 2002 against the defendants in Suit No. 1035/2000 seeking a specific performance of contract in which the parties have entered into a compromise but subsequently J.M. Nos. 24 and 25 of 2004 were filed under Section 12(2), C.P.C. In which the Court has appointed Commissioner for recording of evidence and presently the said two J.Ms. Are pending. He states that as the appellant has vital interest in property of Suit No. 1034/2005 the appellant wishes to become party in the said suit and that the appeal may be disposed of by observing that the appellant will be allowed to become a party in the said suit. Any person who wishes to a become a party in a suit is entitled to make an application and upon satisfaction that it is either necessary or proper party, the Court will join such party in the suit either as plaintiff or defendant and such question will be considered on merit of the application. The appellant may, make an application in this regard which will be decided by the learned Single Judge in accordance with law.
