UMAR ATA BANDIAL, J.--- By consent this writ petition is disposed of with the order that the petitioner shall positively vacate the premises occupied by him, and which belong to the respondent No. 1, on or before 31.12.2009. In case the said premises are not vacated on or before the said date then by consent and without prejudice to any other remedy or relief the petitioner shall as recompense for the prolonged litigation in this matter forego the right to the payment of Rs.
2. 1,00,000/- (rupees one hundred thousand) out of the amount of advance that in refundable to him by the respondent No. 1. In case respondent No. 1 avoids to take over the possession of the premises then the petitioner shall hand over the keys of the locked premises on or before 31.12.2009 to the learned Rent Tribunal as compliance of this order. Disposed of accordingly. .
