Brief facts of the case are that petitioner had been using broad band connection / modam supplied by the respondent which was collapsed by short circuit resulting in loss of petitioner's computer set, modam and three telephone sets. Petitioner demanded the suit amount (Rs.45,000/-) from respondent as compensation for the loss suffered due to respondent's defective services but they did not respond. Not only this, respondent's company is still sending monthly bills for payment of broad band charges, hence this petition.
2. Process was issued for the appearance of respondent but they did not turn up despite service.
They were, therefore, proceeded ex-parte.
3. Petitioner appeared as PW-1 and also produced documentary evidence in support of his claim.

As already stated, petitioner's ex-parte evidence has not been rebutted by respondent since proceeded ex-parte, therefore, the same is relied upon and petitioner's claim is accepted to the extent that respondent shall not demand monthly charges for broad band connection / service from petitioner. The respondent shall also pay litigation expenses of Rs.5000/- to the petitioner whereas petitioner's remaining claim is hereby dismissed. After due completion, file be consigned to record room.
