' CH. IFTIKHAR HUSSAIN, J.- Applicant Jamal-ud-Din by way of the instant application has sought for transfer for the revision petition titled Jamal-ud-Din v. Jamat Ali and others from the Court of Rana Riaz Ahmad Khan, learned Additional District Judge, Toba Tek Singh to such Court at Gojra.

It has been contended on his behalf that he is resident of Gojra and the property in dispute is also situated there and the suit in the matter was filed when Gojra Tehsil had not been created and now after it's creating, the Court of Additional District Judge is working there and, hence, for convenience of the parties and being in line with the scheme of law, the revision petition may be withdrawn from the present Court and transferred to some Court at Tehsil Headquarter, Gojra.

As against the same, the learned counsel for respondent Nos.l to 3 has vehemently opposed the instant petition saying that the impugned order was passed by the Court of learned Civil Judge, Toba Tek Singh and thereafter the petitioner himself has brought revision petition against the same at the district headquarter and he so, now can't ask for it's transfer to Gojra; that the learned District Judge has rightly declined his such request/petition on almost similar grounds; that he (petitioner) is an influential person at Gojra and so, they have threat at his hands in going to Gojra; and that the petitioner for some of his ulterior reason has brought this application for transfer of his revision petition from the present Court to Gojra and so there exists no valid reason with him to ask for the same.
4. I have carefully considered the submissions made on behalf of the parties and copies of the record annexed to the instant petition gone into.
5. There is no denying the fact that the suit out of which the revision petition in question has arisen was filed at Toba Tek Singh and it was decided by the Court of the learned Senior Civil Judge there.
There is also no denying the fact that the petitioner has himself filed revision petition in question before the Court of the learned District Judge, Toba Tek Singh. It was on 1-2-2010. It means that it was about 3 1/2 months ago. There is also no denying the fact that the Tehsil Headquarter, Gojra had been created much prior to the same. Respondents Nos.l and 3's side has shown apprehension of some threat to them at his hands in going to Gojra.
6. I have given very conscious thoughts to such situation involved in the matter. I feel that in the broader scenario of the case, the learned District Judge has rightly declined his (applicant) such request. So, I have not been felt persuaded to interfere in the matter. The application, therefore, is dismissed.

7. As the main petition has been dismissed by this Court today, therefore, this miscellaneous petition has lost it's relevance. Dismissed as having gone infructuous.
