1. I am going to decide ex-parte order. According to the petitioner he has purchased a Battery 145 NS of Exide. About 1 1/2 months ago filing the legal notice. some problems accrued in the Battery and therefore Battery did not work according the respondent. Warranty was also with the Battery and respondent was under obligation to return the same. The petitioner has examined himself as PW-1, Muhammad Abid Ali PW-2, and Tanveer Ahmad as PW-3, legal notices is Ex-P/2, its dispatch receipt Ex-P/3 and receipt of courier service Ex-P/4, Ex-P/5 is affidavit of PW-2 and Ex-P/6 is affidavit of PW-3. Rs. 2, 00,000/-has been claimed for mental torture, cost of Battery Rs. 10500/- expense of visits Rs. 5000/-. The claim is decided in the way that respondent shall pay Rs. 10,500/- cost of Battery (subject to return if in the possession of the petitioner) Rs. 5,000/- as visits charges and Rs. 10,000/- as mental torture. Thus total claim is decreed Rs.25,500/-ex-parte whereas remaining claim of the petitioner is hereby dismissed being on the higher side with no order as to cost.
