1. Complainant's case is that respondent No.1 Imran Ullah proprietor I. R International Travel Shop Gujranwala offered a Hajj package in the year 2008 and received Rs. 4,90,000/- for a package fee of complainant and his wife Tahira Perveen. It was agreed as per offer made by the respondent No.1 that residence at Macca Mukarma shall be provided at the distance of 800 meter at the Haram, the residence at Madina Munawara shall be provided at 350/400 meters from the Masjid- e-Nabiwi. A part from visit to all sacred places, transportation, fooding and lodging during the Hajj shall also be provided to the complainant and his wife. According to the complainant respondent No.1 handed over complainant and his wife to respondent No.2 and performance of this Hajj package because respondent No.1 has no license to operate the Hajj tour. Thereafter respondent No.2 provided a Hajj form No. 77558402 and informed the complainant and his wife to attend the Hajji camp on 03-11-08. They were further transported to Jadha Airport. When they reached Mecca Mukarma no body attended them the residence was provided 3200 meter from Haram where bathing facility was not available. Complainant visited the sacred places at his own expenses at Mecca and Medina. An amount Rs. 8000/- per head for animal sacrifice, were received by the respondents but the animal scarification were not done as promised in the presence of complainant. By way of failure to provide the requisite facilities during the Hajj tour respondents have been guilty of providing of deficient service. Complainant prayed that respondents may be directed to take the complainant and his wife once again on the Hajj tour to return the amount of animal sacrifice and also paid the damages of Rs. 4,00,000/- to the complainant.
2. On the other hand both the respondent while submitting joint reply denied the contention of the complainant stating that all the facilities during the Hajj as promised were provided to complainant and his wife.
3. In order to prove his case complainant appeared as PW1 and his wife Tahira Perveen as PW2 and produced on record receipt issued by I. R international Travels an amount of Rs. 4,90,000/- exhibit "PA", receipt issued by respondent No.2 an amount of Rs. 16000/- exhibit "PB", receipt of animal sacrifice exhibit "PC", letters for information of flight exhibit "PD"&"PJ", copies of legal notices mark "A"&"B", receipts of dispatch of legal notice exhibit "PE"&"PG", ADs exhibit "PF"&"PH".
4. Whereas respondent produced Muhammad Ashraf as RW1 and Qaderdad as RW2.
