Petitioners Ghulam Yasin and Munir Ahmad seek pre-arrest bail in case FIR No, 278/2009 dated 27.5.2009 for offence under Sections 452/379/148/149 PPC registered at Police Station Luddan District Vehari.

It is inter-alia contended that petitioners are innocent and have committed no offence whatsoever; that they have falsely been roped in the present case with mala fide intentions and for ulterior motives by the complainant, in connivance with the local police, that complainant is closely related to Muhammad Irfan complainant of case FIR No, 188/09 which was registered against the complainant who is specifically named in the above referred case FIR No, 188/09 as one of the accused and other so-called PWs; that in fact subsequent to the registration of above mentioned case FIR No, 188/09. Petitioner was injured by the present complainant party, however, the police did not register a case; malice of the complainant is also apparent from the fact of this matter that all five brothers of the petitioners have been involved in this case; that all of them belonged to Arian brotherhood whereas the complainant of the present FIR belonged to Joiya brotherhood', that PWs named in the FIR are closely related to the complainant out of which one Azhar is specifically named in the FIR No, 188/09; that police even did not joint the petitioner in the investigation.
3. Conversely, learned DPG opposes the submissions made at bar by learned counsel for the petitioner and submits that petitioners are named in the FIR with attribution of specific role; that they have been found guilty during the course of investigation.

Admittedly the complainant of present case as well as one PW namely Azhar is,specifically named accused in case FIR No, 188/09 got registered by Muhammad Irfan real brother in law of petitioner Ghulam Yaseen. The petitioners have joined the investigation. The allegations are of general nature. Possibility of false implication of the petitioners on account of existing enmity between the parties cannot be ruled out. In view whereof, this petition is allowed. Ad-interim pre- arrest bail already granted to the petitioners is hereby confirmed subject to their furnishing fresh bail bonds in the sum of Rs, 1,00,000/- (one Lac) each with one surety each in the like amount to the satisfaction of trial Court.
