UMAR ATA BANDIAL, J. --- C.M. No. 1/2009. Submits that this petition pertains to a service matter and by a ministerial error it has been linked up with the matters pertaining to the challenge to vires of Section 15 of the Financial Institutions (Recovery of Finances) Ordinance, 2001. Consequently, the final judgment passed in this case on 29.1.2009 proceeds on a premise alien to the cause in this petition. Submits that the order be reviewed and recalled and the petition be decided on its merits.
2. The petition has been perused. The submission made by the learned counsel in respect of the cause dealt with by the petition is noticed to be correct. Accordingly, the judgment of this Court dated 29.1.2009 is not based on the grevance but proceeds on a different matter not raised in this petition. It has obviously been printed in this case by a ministerial error treating the petition to be a connected by the said judgment. Accordingly the judgment in this petition is re-catted. The petition shall be heard and decided on its merits. The interim order prevailing in the case prior to the judgment dated 29.1.2009 shall stand restored. C.M. Disposed of.
