Brief facts of the case are that petitioner is a zimidar in Tehsil Kamalia. He himself cultivates his agricultural land and also runs a poultry farm. In November / December 2009, respondents charged him for consumption of zero reading at fixed charges but latter on sent him detection bill of Rs.6950/- which was paid by the petitioner. Then the respondents again sent a bill of Rs.5000/- followed by other detection bills for payment of Rs.3017/- and Rs.955/-. The petitioner approached respondents for redressal of his grievance but they paid no heed nor responded to legal notice sent by the petitioner on 15-2-10. Hence, this petition for correction of bills with the direction for the respondents to issue correct electricity bills in future.
2. Petition was contested by the respondent by filing written statement. After receiving written statement petition was fixed for the evidence of petitioner but his statement in the form of petitioner's sworn affidavit dated 21-6-10 was not cross-examined despite availing a number of opportunities. Respondents party was, therefore, proceeded ex-parte and petitioner evidence completed his evidence which comprises his statement on oath Ex-P1, legal notice Ex-P2, postal receipt Ex-P3 and copies of electricity bills for the months of December 2009, January 2010, February 2010 and March 2010 Ex-P4 to Ex-P9.

4. As already stated, petitioner's evidence is ex-parte, therefore, the same is relied upon and petition is accepted ex-parte. Respondents are directed to issue correct electricity bills strictly according to the reading of electricity consumed by the petitioner. Petitioner would produce a copy of this order to the officer concerned in respondent's office for compliance.
