1. C.M. No, 161-C of 2010 and C.M. No,3-C of 2009 ' UMAR ATA BANDIAL, J.--- This is an application to place documents on record. The same is allowed subject to all just and legal exceptions. C.M. Disposed of.
2. Main case ' This revision petition is filed against the order dated 20-7-2009 passed by the learned Additional District Judge, affirming interim injunction given to the respondents against interference in his possession of land by the petitioner Education Department. The respondents claim that the land upon which the Director Colleges, Faisalabad is constructing a Men's College stands allotted to the respondent Yousaf Ali under the settlement laws.
3. 2 .Today before the Court the learned counsel for the respondent Yousaf Ali has made the statement that in so far as the existing construction and structure of the Men's College is concerned, the respondent has no objection if the same be maintained but a restriction be imposed on further construction in the premises of the said College until determination of the suit.
4. He states that the respondent also has no objection if the boundary wall of the said College is completed.
5. 3 . Learned A.A.-G. On instructions stated that the construction of the main building of the College has been completed and only the boundary wall remains to be completed. According to the statement of the learned counsel for the respondents it is ordered that the boundary wall of the College may be completed but no further construction shall be made within the College premises until decision of the suit.
6. C.M.No,3/C of 2009 The applicant seeks leave to become party to the instant proceedings on the strength of pending litigation before the M.B.R. Colonies. Learned counsel submits that the applicants' interest is being affected by the present civil litigation.
7. C.R. No,2210 of 2009 4 . If the applicant has any legal right in the subject property, he may seek seek its enforcement in accordance with law from the competent forum. There is no occasion for the applicant to join these proceedings which merely concern the claim asserted by the respondent before the civil Court against the petitioner defendant and not against the claimed right of the applicant.
8. Accordingly, this application for non-maintainability and the main revision petition in term of the arrangement agreed above are both dismissed.
