ORDER

MIAN SAQIB NISAR, J. --- Despite service, none appears for the respondent. It is stated that the petitioner was married to the respondent, but the spouses are separated. The petitioner is living with her parents at Lahore and has filed a suit for the dissolution of marriage before the Family Court at Lahore, while the respondent, as a counterblast , has instituted a suit for the restitution of conjugal rights before the Family Court at Kasur, which should be transferred to Lahore.

2. After hearing the learned counsel for the petitioner, I find that under the law, the suit of the respondent before the Family Court, Kasur cannot proceed on account of the lack of territorial jurisdiction and should be transferred to the Family Court, Lahore. Resultantly, the suit of the respondent is withdrawn from the Family Court, Kasur and is entrusted to the Court of Mr. Mansoor Atta, Judge Family Court, Lahore, where the suit of the petitioner is pending. Disposed of.
