1. ' We have heard the learned counsel for the petitioner, learned A.A.-G. As well as respondents Nos. 1 and 2. We have also perused the report submitted by Mr. Ghulam Nabi Memon, DIG., Headquarters, Sindh. According to the Report the properties in question were purchased by Mst. Rani and while she was residing in Dubai, petitioner Atiqur Rehman by fraudulent means transferred the ownership of the said properties in his name.
2. ' Thereafter Mst. Rani shifted to Pakistan and lodged a criminal case against Atiqur Rehman, who in retaliation also got registered a criminal case against her and her family.
3. ' Mr. Sathi says that both the parties have also filed civil suits against each other and the same are pending in Civil Court, Karachi. He further says that this is a civil matter and pending decision of the same, the criminal proceedings lodged by the parties against each other may be stopped.
4. Learned A.A.-G. As well as respondents Nos. 1 and 2 have no objection.
5. We have heard the learned counsel for the petitioner, learned A.A.-G. As well as respondents Nos. 1 and 2. We have also perused the report of the D.I.G. In the facts and circumstances of the case, we are of the opinion that the proceedings lodged by the parties against each other should await the decision of the civil suits. . The petitioner shall not create any third party interest in the properties in question till the decision of the civil suits.
6. ' Petition stands disposed of in the above terms.
