ORDER

1. Mr. Dur Muhammad Shah, learned counsel for K.B.C:A. Undertakes on behalf of K.B.C.A. That the fate of the present plan submitted by the petitioner shall be decided within two weeks from today positively.

2. The matter has been delayed inordinately and the building plans were submitted by the petitioner from time to time, way back in the year 1995, and secondly in the year 2005, but no action has been taken in respect of the same, as they were allegedly lost in the office of the Buildings Authority and now the present plan is also pending with K.B.C.A. Since 17th February, 2009 without any action.

3. We would, therefore, direct the Chief Controller of Buildings to ensure that the fate of the present plan be decided in accordance with laws within two weeks from today positively, or else he would be required to give his written explanation for inaction or delay.

4. The petition stands disposed of, in the foregoing terms . .
