2. In the instant case the only dispute between the petitioner and respondent No,4 is about their posting both desire his posting on the basis of his own choice petitioner and respondent No,4 were selected for the post of Secondary School Educator (Computer Science).
3. Learned counsel for the petitioner contends that on 7-8-2000 another Khalid Bashir has also been elected and posted at Government High School Thaheem Wala, who refused to join as Secondary School Educator; petitioner filed an appeal before the Executive District Officer (Education) for his posting in the said Government High School, Thaheem Wala and his appeal is still pending before E.D.O. (Education), Muzaffargarh; further submits that prior to the decision of the appeal respondent No,4, Sajid Hussain has been appointed in the school where the petitioner had been appointed and petitioner is aggrieved of the appointment of respondent No,4 at Government High School Thaheem Wala, District Muzaffargarh.
4. Respondents officials produced the record of posting of the present petitioner and respondent No,4. The merit list produced by the Litigation Officer, Education Department, Muzaffargarh shows Altaf Hussain respondent No,4 was selected on merits and his name in the merit list is at serial No,1 for Government High School Bara. The application submitted by him also mentioned his preference at serial No,8 for his appointment at Government High School, Bara. While application of Sajid Hussain son of Muhammad Hussain submitted application for Government High School Thaheem Wala, Alipur. In the merit list prepared for Government High School, Thaheem Wala Sajid Hussain, respondent No,4 is at serial No,1 produced before this Court. Sajid Hussain, respondent No,4 is rightly appointed at Government High School, Thaheem Wala. The grievance of the petitioner is not genuine. If Sajid Hussain has been appointed in Government High School, Bara his distance from his resident would have greater than Altaf Hussain. The posting of both selectees, present petitioner and Sajid Hussain, respondent No,4 were made according to the policy formulated by the Government of the Punjab. No injustice is caused to the petitioner.
