1. The appellant has impugned the order dated 14.5.2008 whereby the intervenor therein has been added a party to the proceedings on the ground inter alia that he has acquired two plots in Yousuf Goth and since long he is .In possession thereof. Learned counsel present in Court extended their no objections to such joinder. Petitioner claims that the claim of the intervenor is not sustainable and the respondent No. 1 has no right to be joined in the proceedings and he could maintain a separate suit since the intervenor claims the right and interest in the property of which the appellant also claimed right and interest.
2. We do not see any error on the face of the record or any illegality in the order passed by the learned Single Judge. Mr. Manzoor Ahmed, Advocate for the C.D.G.K. States that the subject plot has already been auctioned on 26.1.2006. According to Mr. Manzoor. Ahmed, both the plaintiff and the intervenor are trying to keep the auction purchaser out of proceedings to obtain some collusive orders. It may be observed that the C.D.G.K. May bring such fact to the notice of the learned Single Judge proceeding with the case and the Court may, if so considers expedient and necessary may also join such auction purchaser as party to the proceedings. In view of the above the appeal alongwith listed application is dismissed. .
