Perusal of petitioner's claim would reveal that in February 2010 he purchased six KG seed of "Bhindi Tori" from respondent but to his dis-appointment, the seed did not germinate with the result that the petitioner had to suffer loss on account of sale price of seed, expenses of sowing and damages for mental torture. On 10-4-10 the petitioner issued legal notice to the respondent but filed this claim on 8-6-10 i.e. After 28 days from passing one month statutory period prescribed for filing of claims under Punjab Consumer Protection Act 2005. Moreover, controversy of present nature is also not cognizable by Consumer Court as seed of plant is not covered by definition of "product" as defined by Punjab Consumer Protection Act 2005.
3. In view of above, complaint may be returned to the petitioner for presentation to a court of competent jurisdiction. As this court lacks necessary jurisdiction, therefore, specific findings on objection of limitation are not being given. After completion, file be consigned to record room.
