1. Shahid Munir, Advocate, claimant has filed a petition/claim that his head hair were falling and he met Muhammad Asif respondent No.03 on his shop and told him about his above said disease.

2. Muhamad Asif respondent No.03 told him that he is employee of Scalp Med Advance and if he purchased the Oil & Shampoo of his company and use the same, the new hair will be grown.

3. Petitioner further maintained that he has purchased the above said Oil etc. For the consideration of Rs, 4500/- and he started using of the same. After using of the above said oil and shampoo his head hair started falling rapidly.

4. Muhammad Asif, respondent No.03 is resident of Sargodha while the respondent No.01 is resident of Islamabad and Respondent No.02 is resident of Faisalabad. The petitioner had not produced any document that respondent No.03 is employee of respondent No.01 and No.02. Due to this reason respondent No.01 and 02 were not summoned and proceedings against the Muhammad Asif, respondent No.3 were initiated.

5. Muhammad Asif, respondent No.03 did not turned up in the court despite service and ex-parte proceeding is initiated against him.

Shahid Munir, Advocate, petitioner appeared in the witness box and deposed that 03 months ago his head hair stated falling and on the asking of respondent No.03 he has purchased the oil and shampoo for Rs, 4500/- and thereafter his head hairs started falling rapidly. As the head hairs of petitioner were already falling and despite the use of above said oil and shampoo purchased by him from the respondent No.3 for Rs, 4500/-, he could not get the benefit which means the above said Oil and Shampoo was not up to the mark. The case of the petitioner against the Muhammad Asif, respondent No.03 is proved. Hence Muhammad Asif, respondent No.03 is ordered to pay Rs, 4500/- the cost of the Oil as the petitioner was already suffering the disease of falling of hair before the using of above said oil and shampoo due to that damages are not imposed. File be consigned to record room after due completion.
