ORDER

1. ' SAYED ZAHID HUSSAIN, J.--- Suit titled "Sajjad Ahmad v. Saima Hassan" is sought to be transferred from the Family Court, Lahore to Family Court, Sargodha where a suit for maintenance filed for the petitioner is statedly pending.

2. ' The notice issued to the respondent has returned back unserved with a report that he does not reside at the given address. From the perusal of the plaint of the suit filed by the respondent himself is quite evident that it is the same address (where the notice was sent) as was given by him in suit. The conduct of the respondent appears to be evasive. He is proceeded ex parte.

3. Since the marriage between the parties took place at Sargodha and suit filed by the petitioner for maintenance for herself and her minor is also being tried at Sargodha, I am inclined to order the transfer of the suit pending before the Family Court at Lahore to the Family Court at Sargodha where both the suits will be tried together. The said Court will proceed with the trial of the two suits after notice to the respondent.

4. ' This application is allowed and disposed of accordingly.

5. Suit transferred.
