ORDER

M.A. ZAFAR, J- Mate Raja Muhammad Yaqoob petitioner in a Railway Department has filed this petition under Article 199 of the Constitution of Islamic Republic of Pakistan, 1973, with the following prayer:- "It is therefore, respectfully prayed that this writ petition may be accepted and a direction may be issued to the respondents to take the petitioner on his, duty without any delay or failure."

2. According to the averments of the writ petition, petitioner joined Pakistan Railway and had 24 years service to his credit. He was promoted as a Mate and performing his duties for the last 18 years, the petitioner had been performing his duties under PW-1 Incharge Nazir Ahmad at Lalamusa (respondent Np. 3). On the promotion of one Pervaiz as a Mate recently, petitioner was relieved from service by respondent No. 3 and was directed to report to respondent No. 3. Petitioner under the direction of respondent No. 3 reported to respondent No. 2 for joining his .Duty, but the respondent No. 2 firstly delayed the matter and two days back he has totally refused to take the petitioner on duty.

3. The main grievance voiced through this petition is that on the one hand respondent No. 3 released the petitioner from his service and on the other hand respondent No. 2 is not taking him on duty. On account of mala fides on their part, both the respondents are not passing any written order or if any such order has been passed, they are not disclosing/delivering the same to the petitioner.

4. Be that as it may, let a copy of this petition alongwith all the annexures be sent to the Assistant Engineer Jhelum to look into the matter and redress the grievance of the petitioner in accordance with law, pass an appropriate order and also give an opportunity of hearing to petitioner before passing any order far and against him. The, needful must be done within 15 days from the receipt of the orders from this Court and compliance may also be sent to this Court through Deputy Registrar (Judicial). Disposed of.
