1. On 12-08-09 respondent were proceeded exparte due to absence and exparte evidence of the complainant was recorded. On the very next day i.e 20-08-09 respondent filed this application seeking setting aside of the exparte proceedings stating the reason that their absence was due to misunderstanding about date of hearing. The very fact that immediately on next day the respondent appeared and filed application which is duly supported by an affidavit shows vigilance on the part of the respondent to pursue their cause. Law otherwise favours decisions of cases on merit therefore application is allowed and exparte proceedings initiated vide order dated 12-08- 2009 is set aside. Complainant is directed to procure the attendance of his witness namely Khawar Amin on the next date of hearing who shall be cross examined by the respondent. Now to come up on 30-09-09.
