1. Muhammad Iqbal Khan filed complaint against APX International Courier Services/DHL World Wide Courier Services stating the on 14-04-08 he entrusted a parcel to the respondent for its onward transmission to his brother residing in AREZZO Italy. Rs. 1650/- was received by respondent and receipt was issued with the promise that within 36 hours the said parcel shall reach its destination.
2. According to the complainant respondent failed to fulfill its obligations and the parcel never reached to its addressee. Respondent was approached for redressal of the grievances and a legal notice was served upon but even than respondent did not pay heed.
3. Respondent was summoned by the court and inspite of due service respondent did not choose to appear, therefore, exparte proceedings were ordered to be initiated on 18-02-09. Complainant in order to substantiate his case produced Muhammad Tariq PW2, Muhammad Sadique PW3 and himself appeared as PW1. Besides, complainant produced receipt issued by respondent Exhibit "P1", receipt issued by TCS courier service Exhibit "P2" and "P3" alongwith copy of legal notice mark "A".
4. Exhibit "P1" is a receipt issued by respondent office which shows that the parcel was received from the complainant and Rs. 1650/- were charged. Receipt Exhibit "P3" shows that subsequently the same document were dispatched by the complainant through another courier service for which he had to pay Rs. 1957/-. The witness as produced by the complainant has corroborated the story mentioned by the complainant. In the absence of any evidence of the respondent in rebuttal, case of the complainant through his evidence is proved to the extent that he deposited a parcel with respondent company and same was not delivered to its addressee and in this way respondent is guilty of providing deficient service to the complainant. Payment of Rs. 1650/- to the respondent's company and another payment of Rs. 1957/- to TCS courier services have been proved. No prove of the counsel's fee has been placed on record. Complainant's version that his brother has to pay fine Rs. 1000 Euro due to non delivery of the documents has also not been proved, therefore, the complaint is accepted and respondent being found guilty for providing its deficient service to the complainant is directed to pay to the complainant:- Rs. 1650/- fee of parcel charged by the respondent.
5. Rs. 1957/- fee charged by the TCS courier services.
6. Rs. 1000/- as legal expenses Rs. 3300/- as counsel fee.
7. Total Rs. 7907/-.
8. Within 15 days of the passing of this judgment without fail. File be consigned to the record room after its due completion.
