1. Muhammad Aslam, petitioner has filed a petition/claim against the respondents Ghulam Yasin and Sheikh Hafiz Sohaib-ul-Hassan, Proprietors of Shop namely Saasta Cycle Store, Liaqat Market, Sargodha. Wherein petitioner maintained that on 23.01.2009 he had purchased a Emergency Light in lieu of Rs, 1000/- from the respondents and bearing warranty of six (6) months, but the same light became out of order within 20 days. He had complained the respondent about the defective light but they ignored the complaint of petitioner on one and other pretext and respondents had also refused to change the emergency light. He further mentioned that on 27.04.2009 he had sent a legal notice to the respondents but they paid no heed on legal notice and had not given any reply.

3. The respondents were summoned, through registered post as well as messenger, but they had not turned up inspite of serves and ex-partee proceedings were initiated against them. The statement of the petitioner was recorded. He had deposed and corroborated his petition in all particulars. He had produced a card of respondents where the warrantee of six months is mentioned, which is exhibit P-A. He had produced legal notice P-B and receipt of post office P-C. It is proved from the evidence that Emergency Light was purchased by the petitioner from the respondents, but the same became out of order within 20 days. Emergency Light was returned to the respondents for its replacement but response of the respondents remained lukewarm in this regard.

4. Petitioner had seen perusing the matter and he is entitled for damages also. Hence it is ordered that respondents shall pay Rs, 1000/- the cost of Emergency Light and Rs, 5000/- as damages to petitioner. File be consigned to record room.
