1. Muhammad Akhtar, petitioner has filed a petition/claim against the respondents Naveed Director and Amir Iqbal Managing Director of Qartaba Travels, University Road, Sargodha for defective services under section 13 of the Punjab Consumer Protection Act, 2005. Wherein petitioner maintained that his brother had purchased two return tickets of Ozibic Air Line for Azarbyjan from the respondents in the month of April, 2009 the tickets were given to the respondents for getting money and respondents had promised to the petitioner that they will return the money on 1st July, 2009 and receipt was given to the petitioner in this regard. Petitioner went to the respondents as per promise but respondents did not refund the money. Petitioner repeatedly visited the respondents but they paid no heed and lingered on the matter on one and another pretext. He sought Rs, 28000/- as return tickets money and 15000/- compensation.
2. The respondents were summoned, through messenger, but they had not turned up in spite of serves and ex-partee proceedings were initiated against them. The ex-partee evidence of the petitioner was recorded. The statements of Muhammad Akhtar, petitioner, Pw-1 and Muhammad Rafique, Pw-2 were also recorded. Muhammad Akhtar, petitioner deposed in his evidence that he had given tickets to the respondents for refund of Rs, 28000/- and respondents did not refund the said money to the petitioner. Petitioner went again and again to the respondents for redressing of his grievances but the response of the respondents was lukewarm in this regard. The petitioner produced exhibit-P-1 receipt by the respondents, exhibit P-2 receipt regarding promise to refund of Rs, 28000/- by the respondents and Legal Notice P-4 was served by the petitioner to the respondents according to la, the receipt of post office exhibit-P-5 is in this regard. Muhammad Rafique PW-2 has deposed that he had purchased two tickets from Qartaba Travels, respondents in the month of March 2009 in lieu of Rs, 108000/-. On 1st April, 2009 he along with his friend reached in Azarbyjan on said return tickets issued by respondents. After few days their programme was changed about return to Pakistan and he sent the tickets to his brother Muhammad Akhtar, petitioner for refund of money Rs, 28000/- of return tickets but Rs, 28000/- is still not refunded to the petitioner by respondents.
3. In view of the statements of the Muhammad Akhtar, Pw-1, Muhammad Rafique, Pw-2 the receipt P- 2, receipt P-1 Legal Notice P-4, the petitioner has proved his claim against the respondents. Hence Naved Director and Amir Iqbal Managing Director of Qartaba Travels, respondents are ordered to refund Rs, 28000/- and also pay Rs, 15000/- as compensation to the petitioner. File be consigned to record room after due completion.
