1. Muhammad Abu Bakkar, the petitioner, has approached this court under section 13/14 of the Punjab Consumer Protection Act, 2005 submitting that about 04 Months back prior to the institution of this petition he purchased mobile number 0301-7967298 at this ID Card number 33201-1515722-9 from Mobilink Company. It has come to his knowledge that some illegal numbers such as 01.0301- 3011146 02. 0301-3012012 03.0300-9352220 04.0301-3015557 05.0300-9355507 has also been issued at his ID Card by Mobilink Centre in Bucha Plaza University Road, Sargodha.
2. He appeared the said Mobilink centre with the request to disconnect above said numbers but they refused. He has alleged that Mobilink Company provided him faulty services. He prayed that respondent be punished in according with law and be directed to disconnect above said illegal numbers issued on his ID Card.
3. Incharge of Mobilink Company was summoned. He was served by representative of court and also through registered posts as well as TCS. He did not bother to come to the court.
4. Today petitioner has submitted his affidavit as well as affidavit of one Muhammad Asif. Both the witnesses shave stated that petitioner bought only one mobile phone number that is 0301-7967298 at his ID Card. In this situation,this situation, this court is of the view that by issuing above said unauthorized phone number to others, the respondent company has provided defective services to the to the petitioner. Since there is no defense on the part of Mobile Company. So, this court is left with no option except to accept the claim of petitioner.
5. In these circumstances Mobile Company, the respondent, has fined Rs.20000/- under section 32 of the Punjab Consumer Protection Act, 2005. They are also directed to disconnect the above said unauthorized Phone numbers. They will be pay compensation to the petitioner amounting to Rs.
