PERVAIZ INAYAT MALIK, j..--- Briefly stated facts as those emerge out of this petition are that the petitioner on the basis of her F.Sc. Qualification applied for her admission in any of the Medical Colleges in Punjab against five- seats reserved for under developed District Rajanpur and in the merit lists. She was at Sr. No. 6 and since there were limited number of seats, therefore, she could not get admission. It is the case of the petitioner that still two seats meant for open merits and lying vacant and candidates, who were allowed admission against quota of District Rajanpur at Sr. No. 1 can be adjusted against vacant seat of open merit. Resultantly, one seat would be available, whereagainst the petitioner can be allowed admission.
2. It is inter alia contended that out of the candidates, allowed admission against reserved seats for District Rajanpur in M.B.B.S. Sessions 2007-2008. The last candidate Sheraz Ahmad s/o Riaz Ahmad secured 79.345% marks and was allowed admission in Sh. Zaid Medical College, Rahim Yar Khan and the last student allowed admission on open merit at Quaid-e-Azam Medical College, Bahawalpur had secured 80.682% score/average marks; that Miss Hurina Hafeez d/o Hafeez-ur- Rehman_ secured admission in Nishtar Medical College, Multan against reserved seat of District Rajanpur with 80.682% score/marks; that still two seats against open merit are vacant at Quaid- eAzam Medical College and if Miss Hurina Hafeez is allowed admission upon open merit seat. In that eventuality the 5th seat reserved for District Rajanpur would become vacant, whereagainst the petitioner is entitled to get admission at this belated stage.

In support of his a contention, Mr. Tahir Mehmood, Advocate learned counsel for the petitioner has referred to certain precedent cases, which also find mentioned in writ petition and order passed by this Court in I.C.A. No. 3/09 to canvass that similarly placed Miss Madhia Sagher was allowed admission in Sh. Zaid Medical College, Rahimyar Khan in the year 2007-2008 during first week of April, 2009.
4. Neither in the para-were comments nor during the curse of arguments contents of writ petitioner on factual plane nor'the submissions made at the bar are controverted. The only point, being urged before this Court is that the session is about to be over and if would create hardships if petitioner is allowed admission, at this belated stage.

6.Ce the facts narrated in the writ petition stands admitted and there is no rebuttal to the submission made at the bar by Mr. Tahir Mehmood learned counsel for the petitioner, besides, order passed in I.C.A. By this Court by a Division Bench referred to Supra is admitted and consequent admission of Miss Madhia Sagheer, in the first week of April, 2009 is also not denied.
7. By now it is well-settled proposition of law that similarly placed persons are to be treated alike. I find force in the arguments of learned counsel for the petitioner that she is being discriminated while respectfully following the judgments referred to above/passed in I.C.A. By the Court, this petition is allowed, with a direction to the respondent to adjust Miss Harina Hafeez-ur-Rehman's, who was admitted against reserve quota for District Rajanpur by securing 80.682% score in Nishtar Medical College, Multan, against open merit and allow admission to the petitioner against seat which will fall vacant, against fifth seat reserved for District Rajanpur, in Quaid-e-Azam Medical College, Bahawalpur.
7. With these observations this petition is disposed of. .
