1. Ch. Muhammad Rafique has filed this complaint against M/s Soldier CNG Station stating that on 21- 09-08 he visited the CNG Filling Station of respondent and asked for filling the tank of his car after which he presented a note of Rs. 5000/- to the salesman who refused to receive the same, misbehaved and caused insult. He issued receipt Exhibit "PA" which does not contained the true description of quantity of the Gas, the pressure of Gas and cost of the CNG.
2. The respondent was summoned who disappeared after attending the court so he was proceeded exparte on 24-02-09. Evidence of the complainant was recorded. He produced Ch. Liaqat Ali Sindhu as PW2 who verified the averment of the complaint. Complainant while appearing in the witness box also narrated the whole occurrence and produced receipt issued by the respondent Exhibit "PA". In the absence of any thing in rebuttal on the record as the respondent was proceeded exparte, case of the complainant is proved that respondent provided deficient service and failed to comply with the provision of section 19 of the Punjab Consumer Protection Act, 2005. However complainant has not suffered any damage, therefore respondent being found guilty of violating the provision of section 19 of the Punjab Consumer Protection Act, 2005 is convicted and is awarded fine of Rs. 10000/- alongwith Rs. 1000/- as cost of the legal expenses which shall be paid to the complainant whereas fine shall be deposit in the state treasury. The complainant himself being an advocate is not entitled for counsel fee. File be consigned to the record room after its due completion.
