Allah Yar, petitioner seeks his post arrest bail in case FIR No, 257/08 dated 29.6.2008 registered under Articles 3/4 of Prohibition (Enforcement of Hadd) Order IV of 1979, at Police Station Makhdoom Rasheed, Multan.

2. The allegation against the petitioner-is that he was preparing the liquor, when he was arrested.

From his possession five bottles of liquor were recovered.

3. Learned counsel for the petitioner submits that only five bottles of liquor were recovered from the petitioner and his case does not fall within the prohibitory clause. Further submits that the petitioner has no previous criminal history.

4. Learned Deputy Prosecutor General, Punjab, submits that the petitioner is nominated in the FIR and he has been apprehended at the spot.

5. The case of the petitioner does not fall within the prohibitory clause and only five bottles of liquor have been shown to be recovered from him. He is behind the bar since 29.6.2008 and challan has not been submitted so far.

6. In view of the above, I am inclined to admit the petitioner to bail subject to his furnishing bail bonds in the sum of Rs, 1,00,000/- with one surety in the like amount to the satisfaction of learned trial Court.
