ORDER

1. This petition was filed on 31-8-2006 stating that the name of the petitioner was put in the Exit Control List and praying that respondents Nos.1, 2 and 3 may be directed to remove it.

2. ' Learned counsel for petitioner had filed a letter dated 8-4-2008, issued by National Accountability Bureau (Sindh) wherein information was given by the N.A.B. Authorities that in view of promulgation of NRO 2007, by operation of law the proceedings against the petitioner stand terminated.

3. ' On 25-9-2008, the learned ADPG had stated that so far he has not been able to collect any material against the petitioner for producing before this Court. Today learned ADPG N.A.B. Has submitted an office note wherein he seeks confirmation as to whether investigation "Ferro Silicon" against the petitioner Akhtar H. Askari is closed or not. Despite the fact that this constitutional petition is pending for two years, so-far no substantive material has been placed before this Court in support of B putting the name of the petitioner in Exit Control List. This Court, has, therefore no other option but to allow this petition and direct respondents Nos. 1, 2 and 3 to remove the name of the petitioner from the Exit Control List.

4. ' The petition is disposed of, in the above terms. Copy of this order may be sent to respondent No,3 directly, for compliance. revisions by the competent authorities.
