Learned counsel for the petitioner placed before us order dated 25.10.2000 passed in C.P. No. D-158 of 2000 by a D.B. Of this Court in which one of us namely Muhammad Moos K. Laghari, J. Was a member. The said order is to the effect that the petitioner should make an application to the concerned authorities for compensation of his lands who after due verification and checking of the claim shall make payment forthwith, In the said order it is also observed that the A.D.B.P, may take lenient view while considering repayment of loan under the facts and circumstances of the case.
2. Learned A.G.G. As well Mr. Khadim Hussain Shaikh, have consented to the passing of such order.
However, Mr. Shaikh prays that they would be filing a suit against the petitioner for recovery of dues of A.D.B.P.

In the circumstances it is directed that the petitioner would approach the concerned authorities for compensation of taking over his lands who after due verification and checking of the claim shall make payment forthwith as admissible to the petitioner. We shall not restrain the A.D.B.P, for filing of recovery suit its dues against the petitioner. The concerned authorities shall issue notice to the petitioner and hear him before passing any order.
