1. Abdul Jabar S/o Muhammad Manzoor filed this complaint against the respondent stating that in December 2008 he purchased four tyres of his vehicle Suzuki Pickup No. GAS-1999 from the respondent's shop after paying an amount of Rs. 9600/- against receipt No. 4773 issued by the respondent. According to the complainant one year warranty for the tyres were issued by the respondent. On 16-05-09 one of the tyre become fermented. The matter was brought into the notice of respondent with the request to replace the defective tyre but he refused to pay heed rather misbehaved. Resultantly on 18-05-09 necessary legal notice was dispatched at the address of the respondent.
2. Respondent was served by this Court but he did not choose to appear so vide order dated 07-06- 09 he was ordered to be proceeded exparte. Complainant himself appeared in witness box in order to prove his contention. He produced Exhibit "PA" receipt No. 4773 dated 21-12-08 issued by the respondent showing sale of four number tyres for a consideration of Rs. 9300/-. Exhibit "PB" is the postal receipt of dispatch of legal notice, copy of the legal notice Mark "A" was also produced. As respondent did not appear so in the absence of any evidence in rebuttal case of the complainant is established. Therefore respondent being found guilty of providing defective tyre is directed to either replace the said tyre or pay the price thereof amounting to Rs. 2325/- to the complainant immediately alongwith Rs. 1000/- as legal expenses and Rs. 1100/- as counsel fee. File be consigned to the record room after its due completion.
