' SYED ZAHID HUSSAIN, J.--- The petitioner who had been teaching in Government Elementary School 177-GB Tehsil Samundari, District Faisalabad as a Senior Elementary School Educator applied for appointment as Elementary School Educator in Government Primary School 440-GB Faizpur, Tehsil Samundari, District Faisalabad. Her application was processed, she was selected for the later post and appointment letter was issued on 27-10-2006. As a consequence, she was relieved from the Elementary School 177-GB, where she was already teaching and joined the new place of appointment and posting. It was, however, on 7-11-2006 when she was conveyed that her appointment order had been withdrawn "due to already working as SESE at Government Elementary School 177-GB". This way she has lost her job as SESE and ESE. This order of withdrawal of her appointment is sought to be assailed through this petition under Article 199 of the Constitution of Islamic Republic of Pakistan, 1973.
2. ' Parawise comments have been filed. The learned Additional Advocate General points out that though the appointment of the petitioner was in contravention of the Recruitment Policy Clasue- 10(iii) as she could not apply or be appointed to this post yet for the redressal of her grievance she could apply to the Recruitment Complaint Redressal Cell where her case will he examined by the said Cell sympathetically.
3. ' The learned counsel for the petitioner has attempted to advance justification for her appointment but I am not inclined to go into this question due to the availability of remedies to the petitioner i.e before the Recruitment Complaint Redressal Cell or the Punjab Service Tribunal.
4. ' The petition is disposed of accordingly with the above observations.
