1. Rana Faqeer Ahmed complainant filed complaint under the Punjab Consumer Protection Act, 2005 against the respondents in which he has alleged that on 28-06-07 he hire the services from the respondent and made a agreement with the respondent to fill the plot with soil. Whereas the respondent did not provide the services according the contract, due to which complainant has suffered huge lose. He prayed that his claim be accepted and he be awarded damages / compensation for mental torture, stress and agony.
2. The complainant sent a legal notice exhibit "PA" to the respondent but the respondent did not pay any heed on it. Resultantly the complaint in hand raises.

The respondent was summoned through ordinary means and on 04-12-07 respondent did not appear and again notice was issued and sent through the Processes Server of this court and on 10- 01-08 respondent appeared with his counsel but on 01-02 08 nobody appeared on behalf of the respondent, therefore, the respondent was proceeded exparte. The exparte evidence is in the form of oral evidence and documentary evidence.
4. Tariq Iqbal appeared as PW1, Rana Faqeer appeared as PW2, Abdul Shaqoor appeared as PW3. All the above PWs almost narrated that same facts in their evidence as narrated in compliant Exhibit "PB".
5. There is no evidence in rebuttal.
6. Under these circumstances I accept the petition of the complainant and it is ordered that the respondent shall pay 25000/- rupess. The damages / compensation for the mental torture, stress, agony Rs. 3,00,000/-. The claim of the petition is decreed for a total amount of Rs. 3,25,000/- (rupees three lac and twenty five thousand only) File be consigned in the record room after due to completion.
