1. ' KHAWAJA NAVEED AHMED, J.---Pursuant to the order, dated 1-8-2008, A.S.-I. Syed Imtiaz Hussain, respondent No,2, Imranul Haq, respondent No,3, Saifur Rahaman, respondent No,4 and old lady Mst.
2. Iqbal Begum, respondent No,5 are present in Court.
3. ' This case pertains to a very unfortunate story of an old mother, who is around 80 years of age. She was living with her son Noor Muhammad in a flat for last sixty years in Arambagh. Petitioner in collusion with his one brother-in-Law Aqeel had sold the said flat and had usurped the money depriving his mother any five sisters of their right of sharing the sale proceed. The mother had complained to Arambagh Police while the blind son, Noor Muhammad, had also filed an application to Arambagh Police against his brothers in law Imranul Haq, Saifur Rehman and mother Mst. Iqbal Begum. A.S.-I. Syed Imtiaz Hussain of Arambagh Police Station was entrusted with inquiry and he has submitted his report to his superior police officer cognizable offence has been made out against petitioner Noor Muhammad and Aqeel. In the meanwhile, petitioner Noor Muhammad has filed this petition for harassment.
4. ' This Court has taken a serious view and summoned A.S.-I. Syed Imtiaz Hussain in the Court. A.S.-I.
5. Syed Imtiaz Hussain has produced old mother, Mst. Iqbal Begum respondent No,5, two sisters and their husbands who are victims of this blind man Noor Muhammad and his brother-in-law Aqeel.
6. A.S.-I. Syed Imtiaz Hussain has also filed comments, which are taken on record.
7. ' A.S.-I Syed Imtiaz Hussain is directed to take action according to law. However, he is advised not to settle the civil dispute regarding money/sale proceed of the flat at the police station but if a cognizable offence is made out he should not spare anyone whoever is responsible for cutting the hair of old lady Mst. Iqbal Begum and dispossessing her from the flat' where she resided for sixty years. The learned counsel for the petitioner states that he is denying all the allegations. Let the law take its own course and neither the trial' Court nor the police should be influenced by the observations made by me in this order. They should decide the matter on merits in light of the evidence produced before them.
8. ' This petition is dismissed in limine.
