MUSHIR ALAM, J.-Through instant petition, petitioners had complained of unauthorized construction, of plot bearing No.451-JM, situated at main Jamshed Quarters, Amil Colony No.2, Karachi without approved building plan, lt appears that counter-affidavits have been filed by KBCA and the private respondents. KBCA has reported that - the construction has been raised ground plus three upper floors with minor violation of excess covered area and internal changes, maintaining the COS with no floor violation and regularization has been approved on 15.10.2005. On the last date, even the Nazir had no notice of any violation that may warrant any interference in exercise of writ jurisdiction, ln case, where the violation is found invariably. Demolition and removal of unauthorized construction is directed and like wise where the petitions are found without any just cause and result of some animosity, the same are dismissed with cost; Accordingly, the petition appears to be motivated which is dismissed together with the list application with cost of Rs.10,000/- to be deposited within two weeks and otherwise the petition may be fixed for due enforcement. Dilawar Hussain and Manzoor Ahmad, learned counsels submit that the direction may be given to the petitioner to deposit said cost in the High Court Bar Library Fund within specified period.
