M. SALEEM CHAUDHRY (CHAIRMAN).-Nauroze Ali, A. S. I. Police, appellant, has filed this appeal against the order of D. I.-G. Police, Lahore Range, for the grant of promotion of the rank of S. I. Police.
He made a representation to the Inspector-General of Police, Punjab, which was rejected on 29-5- 1979.
2. Briefly, the facts of the case are that the appellant was recruited as A. S. I. On 3-9-1966 in Lahore Range when it comprised of four Districts, i.e. Lahore, Sheikhupura, Gujranwala and Sialkot. The appellant was posted at Sialkot. Lahore Range was bifurcated on 8-3-1976. Lahore District was made an independent Range and the other three Districts alongwith newly created District of Kasur were made another Range. The appellant was con--firmed as A. S. I. On 5-11-1973 and enrolled in the List `E' on 23-4-1976. He was posted as officiating Sub-Inspector of Police in the Provincial Control Centre in the Home Department, Lahore, and, thereafter he was again sent back to Sialkot District. The appellant being an appointee of Lahore Range made a representation that he be posted at Lahore and he was transferred from Sialkot to Lahore district on 21-2-1978, but put at the bottom of the Seniority List. Because of juniority assigned to the appellant, he was ignored for promotion to the rank of S. I. In Lahore Range.
3. The appellant has urged that he belongs to a joint cadre of A. S. I. Of the original Lahore Range which was bifurcated later on and he was entitled to retain his seniority in terms of Police Rule No. 12.3 on the basis of his original confirmation dated 5-11-1973 in the concerned Range. Thus he was senior enough to be promoted as S. I.
4. The respondent has urged that- the cadre of A. S. I. Is on the basis of Districts and not on, the basis of a Range. Thus the appellant was not entitled to tack his previous seniority in Lahore Range which did not include Gujranwala District.
5. We have seen the Seniority Lists. They are on the basis of the Range and seniority ranking stands on the basis of confirmation as A. S. I. Since the appellant belonged to the combined Lahore Range and had the domicile of Lahore District and his entitlement to be kept in the bifurcated cadre of ripe new Lahore Range had been conceded, therefore, fie was entitled to maintain his seniority with all consequential benefits on the basis of his original confirmation dated 5-11-1973 as A. S. I.
6. In view of above, the departmental authority is directed to correct the seniority of the appellant and to grant him all consequential benef--its accordingly. The order of the Inspector-General of Police, Punjab, dated 24-5-1978 rejecting the appeal of the appellant is, therefore, set aside and the appeal is accepted.
