ORDER

' MUSHIR ALAM, J.-Through instant petition, the petitioners have impugned inaction on the part of the Civil Aviation Authority ("CAA") to construct the Squash Complex and Recreational Club. Faisal Kamal Alam, learned counsel for respondent No, 1 submits that since the dispute was pending in Court and otherwise subject plot was allotted to US Consulate. Learned counsel has placed a copy of the order dated 20-12-2005 passed by the learned Division Bench of this Court in C.P. No, D-155 of 2005. In said petition, the statement was made by Abbas Ali, learned A.A.G. On behalf of the Government of Sindh that "such project is abundant and at present there is no move for using the amenity plot for any other purpose". Therefore, the above said petition was disposed of as such.

2. Faisal Kamal, learned counsel further submits that the project is under active consideration of CAA.

3. Manzoor Ahmed, learned counsel for C.D.G.K. Submits that the land allotted to CAA has since been cancelled, the application for re-consideration moved by CAA is under consideration and some suits are pending as regards the claim of CAA. The claim of the respondent No, 1 as against C.D.G.K. To be decided in accordance with law.

4. Under the circumstances, the petition having served out its purpose, which is accordingly disposed of in terms of the order passed in the petition referred to above. revisions by the competent authorities.
