' SH. ABDUL RASHID, J.----The facts leading to this petition are that Mian Muhammad Zaheer respondent No,2 had got registered an F.I.R. No,320 of 1998, under section 506, P.P.C. At Police Station Old Anarkali, by alleging that he had got registered F.I.R. No,475 of 1998 against the petitioners in which they had secured interim bail and that on 24-11-1998 there was date of hearing in the Court of Additional Sessions Judge at Lahore, which was adjourned as the said Judge was on leave and after he came out of the Sessions Court the petitioners called out Lalkara to kill him and then they attempted to attack him and he ran to save his life and took refuge in his office situated at. G.P.O. And after few minutes, the petitioners again followed him there and attacked him and to save his life he ran out and thereafter the petitioner called out their other companions who were sitting outside in the car. On alaram, the police reached there and they apprehended some of the petitioners at the spot. The petitioners through this petition seek quashment of the said F.I.R. On the ground that there is criminal litigation between the parties on account of which the present case has been got registered and that the contents of the F.I.R. Do not fulfill the definition of the criminal intimation as stipulated under section 503, P.P.C. Because it only amounts to threat simplicitor and the complainant was not made to do any act which he was not legally bound to do or omit to do any act which he was legally bound to do and as such, the F.I.R., warrants quashment.
2. It is borne out from the contents of the F.I.R. That the respondent No,2 who is complainant of this case had also got registered case against the petitioners in which they were on bail and their present attack on him was to prevent him from following the prosecution of the said case and therefore, all the series of acts alleged against the petitioners do not merely constitute threats, simplicitor, but where taken in pursuit of their same design. Therefore, no case for quashment of the F.I.R., is made out and this petition is dismissed to that extent.
3. The investigation of this case stood stayed earlier. Now the S.S.P. Investigations, Lahore, will entrust the investigations to some police officer other than the staff posted at Police Station Old Anarkali, Lahore, and will ensure its fair and honest conduct.
