Learned counsel for the plaintiff contends that the publication of defendant in daily Jang in connection with sale of subject property is not in consonance with law and in contravention of the provision of sections 15(2) and (4) of the Financial Institutions (Recovery of Finances) Ordinance, 2001, therefore, defendant be restrained from auctioning the subject A property owned by the plaintiff. Since similar issues have been raised in C.P. No,1077 of 2008 as well as in Suit No,B-32 of 2008 pending before this Court, therefore, defendant is restrained from auctioning the mortgaged property till next date of hearing. Notice to the defendant for 4-8-2008.
