M. SALEEM CHAUDHRY (CHAIRMAN).-In this case the appellant, who joined the Police Department, as Constable in 1956, was brought on List `A' meant for promotion to the post of Head Constable of Police on 23rd June, 1959. But his name appears to have been removed from the same in 1960. He was again re-enlisted on 15th November, 1965 and, .Was brought on List `A' maintained in the district of Dera Ismail Khan. Earlier he appeared in test in 1961 for promotion to 'List `B', but the result was withheld as he was under orders of transfer to Mianwali. However, according to the information received later, he was said to have passed the test. The appellant went on representing for his promotion. Ultimately, the Superintendent of Police, Mianwali, passed an order (Annexure `B' to the grounds of appeal) to the effect that the Deputy Inspector-General of Police, Sargodha Range, had observed that there was something wrong somewhere, and the representationist i.e. The present appellant, had already been made to suffer a jot, and therefore, he deserved to be compensated.
The Superintendent of Police, Mianwali, therefore, asked for a report if there was any vacancy available to accommodate the appellant. But the appellant still failed to find luck. Eventually, the D.
I. G. Sargodha Range, informed the S.T. Mianwali, that the case of the appellant should be treated to have been closed and no further representation should be entertained from him.
2. Since we cannot interfere in the matter of promotion, therefore we decline to pass any effective order. But we do feel constrained to observe that the case of the appellant is very hard and it deserves a sympathetic consideration at the departmental level.
3. We accordingly observe that the appellant's case may be re--examined and his grievance may be looked into in the light of the relevant rules.
